Terms of Service

Please read these Terms of Service ("Terms") carefully before using the TRAX mobile application ("App") operated by TRAX ("we", "us", or "our"). By downloading or using the App, you agree to be bound by these Terms.

1. Acceptance of terms

By accessing or using TRAX, you confirm that you are at least 13 years of age, have read and understood these Terms, and agree to be bound by them. If you do not agree, do not use the App.

2. Description of service

TRAX is a live location-broadcasting application. It allows one user (the "Broadcaster") to share their real-time GPS location with others (the "Trackers") who have been given the Broadcaster's ID and password. Intended use cases include school and office ferry tracking to help passengers and parents know when transport is nearby.

The App is currently provided as a free beta service. Features, availability, and pricing are subject to change.

3. Beta service

TRAX is in beta. This means the App may contain bugs, experience downtime, or change significantly. We make no guarantees about uptime, accuracy of location data, or continued availability. We may modify, suspend, or discontinue the service at any time without notice.

4. Acceptable use

You agree to use TRAX only for lawful purposes and in a way that does not infringe the rights of others. You must not use the App to:

  • Track any person without their explicit knowledge and consent.
  • Stalk, harass, intimidate, or monitor another person without authorisation.
  • Conduct surveillance that violates applicable laws in your jurisdiction.
  • Share your broadcast credentials with anyone other than those you intend to permit tracking.
  • Attempt to reverse-engineer, decompile, or tamper with the App.
  • Use the App in a way that could damage, disable, or impair our servers or networks.
  • Violate any applicable local, national, or international law or regulation.

Broadcasting implies consent. By activating a broadcast, you confirm that you are voluntarily sharing your location. Only share your broadcast ID and password with people you trust and intend to allow tracking.

5. Location data and privacy

Your use of location features is governed by our Privacy Policy, which is incorporated into these Terms by reference. You are responsible for managing who has access to your broadcast credentials. We are not responsible for unauthorised access resulting from you sharing your credentials with third parties.

6. Intellectual property

The TRAX name, logo, app design, and all related materials are the property of TRAX and are protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to use the App for personal, non-commercial purposes in accordance with these Terms.

7. Third-party services

The App may integrate with third-party services (such as mapping providers). Your use of those services is subject to their respective terms and privacy policies. We are not responsible for the content, accuracy, or practices of third-party services.

8. Disclaimer of warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT LOCATION DATA WILL BE ACCURATE OR TIMELY.

TRAX is not intended to be used as a sole safety tool. Do not rely on it in emergencies or situations where precise, guaranteed location accuracy is critical.

9. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, TRAX SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total liability to you for any claims arising from these Terms or your use of the App shall not exceed the amount you paid us in the twelve months preceding the claim (which, during the free beta, is zero).

10. Indemnification

You agree to indemnify and hold harmless TRAX and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the App in violation of these Terms or applicable law.

11. Termination

We reserve the right to suspend or terminate your access to the App at any time, without notice, if we believe you have violated these Terms. Upon termination, your right to use the App ceases immediately.

12. Changes to these terms

We may update these Terms from time to time. We will notify you by updating the effective date at the top of this page. Your continued use of the App after changes are posted constitutes acceptance of the revised Terms. If you do not agree with the revised Terms, stop using the App.

13. Governing law

These Terms are governed by and construed in accordance with applicable law. Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts in the applicable jurisdiction.
